Background of lawsuit against Donald Trump

The verdict finishes an important trial in which the behavior of Mr.Trump leading up to the 2021 Capitol riot proved him ineligible to run for office again.

This incident happened when supporters of Donald Trump attacked the US Capitol building on January 6, 2021, following the defeat of the 45th US President Donald Trump in the 2020 presidential election. Trump’s inciting behavior was made responsible for the riot of his mob supporters.

However, Mr.Donald Trump did not appear in the Denver court during the hearing. District Judge Sarah Wallace announced the verdict. She ordered the Colorado Secretary of State to include the name of Trump on the state’s primary ballot next year.

In her opinion, Judge Sarah found that Trump participated in a rebellion on January 6. However, the 14th Amendment’s prohibition on uprising while holding office does not apply to people campaigning for presidential elections.

Section three of the 14th Amendment forbids those who swore an oath to protect the Constitution. But then “engaged in uprising” against it from holding public office.

In September, a group of Colorado voters launched a court challenge alleging that Amendment 14 should apply to Trump because of his role in the 2021 riot at the US Capitol.

On the other hand, Ms. Sarah argued in her conclusion that the 14th Amendment’s uprising ban does not apply to presidents. Because Section 3 does not specifically mention them. In this regard, she has declared Donald Trump eligible for the 2024 presidential elections.
