SC imposed a heavy fine on husband for not paying haq mehar
The Supreme Court (SC) today has imposed a heavy fine on the husband for not paying haq mehar on the demand of his wife. Chief Justice of the Supreme Court (CJP) Qazi Faez Isa passed this verdict in a written order.
Justice Qazi stated that a husband is obligated to pay the haq mehar anytime his wife demands it. The haq mehar is a Shariah duty imposed on a husband to pay a specific amount of money based on his will for the security of his wife. The law of Pakistan also protects this Shariah obligation.
Court Hearing and Proceedings
A man had submitted a petition to the Supreme Court to prevent the haq mehar payment of his wife. The Supreme Court dismissed his petition against the payment of haq mehar to his wife.
The court also took strict decision legal action against petitioner Khalid Pervaiz. The court ordered him to pay a rupees one lakh fine for six years of delaying payment of haq mehar to his wife Samina.

The court ruled that if the payment date is not specified in the marriage certificate (nikahnama), the wife may demand it at any time. The wife had to file a case to obtain her haq mehar in the current case. It took six years to reach the Supreme Court.
According to the court verdict, the Supreme Court has not fined the husband for submitting unnecessary appeals. Justice Qazi stated that courts should not be afraid to impose fines to put an end to unnecessary lawsuits.
The Chief Justice criticized the petitioner for failing to pay the haq mehar payment of rupees 500,000 mentioned in the nikahnama for six years. And for allowing the case to drag on for that long.
The lawyer of the petitioner requested to dismiss the case. CJP Qazi stated they would not be able to withdraw the case whenever they wanted.
