Elon Musk sued OpenAI & CEO Sam Altman for breaching founding mission
Tech giant billionaire Elon Musk sued OpenAI and its cofounders, Greg Brockman and Sam Altman once more. Elon filed the latest lawsuit today through his lawyers.
Elon stated in his lawsuit that OpenAI executives deceived him into confounding the company. They exploited his concerns about the serious risks AI presents.
He called the act of Greg and Sam a “textbook tale of altruism versus greed.” It is a perfect example of a situation where one side acts selflessly (altruism). However, the other side acts selfishly for personal gain (greed).
His lawyers claimed that Greg and Sam smartly manipulated Elon by confounding OpenAI. It was supposed to be a nonprofit organization devoted to developing AI responsibly and openly for the betterment of humanity.
The accused co-founders betrayed Elon after he put his name on the project. He spent tens of millions of dollars on the initial investment and hired top AI scientists to work for OpenAI, Inc.
Moreover, they informed Elon that OpenAI will recruit top scientists to compete with Google’s DeepMind to develop artificial general intelligence (AGI).
However, it became a profit organization- as soon as OpenAI started developing AGI. Following this, Elon Musk sued OpenAI co-founders including Sam and Greg.
It is significant to note that Altman, Elon, and Greg established OpenAI as a non-profit research facility in December 2015. Elon left the company in 2018 but his lawyers emphasized that he contributed to OpenAI through the middle of September 2020.
OpenAI now calls itself a “capped profit” business which means company business founders can now maximize their profits from an investment.
It created a new structure called OpenAI in 2019- a hybrid combination of profit and non-profit business. This new structure aims to give its staff and investors a limited profit if the company progresses.

So, Elon’s lawyers argue that this change to a hybrid structure allows OpenAI’s co-founders to make more money for themselves, especially through their partnership with Microsoft in 2019.
However, Elon founded his own AI company xAI in 2023. It was a profitable business whose goal was to advance the collective understanding of the universe.
On the other hand, OpenAI’s partnership with Microsoft rather than with xAI compromised the nonprofit goals of the company. However, OpenAI called this lawsuit “contradictory” and “unclear.”
