LHC ordered removal of Lt. General Munir Afsar as NADRA Chairman
Lahore High Court (LHC) ordered the removal of Lt. General Munir Afsar as NADRA Chairman whom the caretaker government appointed. NADRA refers to the National Database and Registration Authority.
This removal order came after citizen Ashba Kamran filed a petition. She argued that the chairman’s appointment violated the Nadra Ordinance 2000 provisions.
The petitioner stated Lt. General Munir’s appointment did not follow the requirements of conducting a fair. It undermined the competitive process for appointment by inviting potential aspirants.
According to petitioner Ashba, this appointment violates the constitutional principle of citizen’s equality and cancels guaranteed fundamental rights.
Following this petition, LHC ordered the removal of Lt. General Munir Afsar citing an unauthorized appointment that violated NADRA’s regulations.
Justice Asim Hafeez conducted a hearing of this petition today. He penned a decision that ordered Lt. General Munir to be removed from his position. He stated Lt. General Munir’s appointment lacked the mandatory “authority of law.”
According to the court judgment, the NADRA chairman’s appointment constituted an “instance of direct appointment.” The government neither advertised” nor conducted a “qualification-based evaluation conducted.”
Moreover, it stated that an appointment that was not announced and was competitively insufficient. It violated Article 18 of the Constitution.

The court emphasized they would like to clarify that any government appointment can only happen following the publication of an appropriate advertisement. That invites applications from qualified applicants.
The order also continued and stated any appointment to a government job without publicizing the job violated Articles 18 and 27 of the Constitution.
Justice Asim wrote in the court order if someone makes an illegal appointment without proper authority or permission, it can’t be justified or hidden. So, it’s like trying to hide something as big as an elephant in a tiny mouse hole, it’s impossible. The wrongdoing is too big to cover up.
