Justice Naqvi challenges SJC’s proceedings in Supreme Court
Justice Sayyed Mazhar Ali Akbar Naqvi challenges the Supreme Judicial Council’s (SJC’s) proceedings of misconduct against him in the Supreme Court.
Justice Naqvi challenged the proceeding describing the allegations as “false and baseless”. He has pleaded that the proceedings against him be dropped. Since the complaints are “without lawful authority and have no legal effect”.
What are the charges against Justice Naqvi?
Following the publication of audio leaks earlier this year, the Pakistan Bar Council (PBC) filed a charge of misconduct against Justice Naqvi on March 10. According to the audio leaks, former Punjab Chief Minister Pervaiz Elahi discussed the fixation of the matter before a specific bench or judge.
What does the Naqvi’s petition state?
Justice Naqvi challenged the SCJ under Article 184(3) of the Constitution. He claimed that a hostile campaign had been undertaken against him since February 16 as well as a media trial.
The petition stated that releasing a press release without the agreement of the justice not only violated his fundamental rights. But also subjected him to a media trial further demeaning him in the public eye.
In his petition, Justice Nqavi stated that the malicious campaign and allegations have a direct and clear attack on judiciary independence.
