LHC suspends victory notification of two PMLN candidates in NA-81 & NA-133

Lahore High Court (LHC) suspends victory notification of two PMLN candidates Azhar Qayyum from NA-81 Gujranwala and Rana Arshad from NA-133 Nankana Sahib.

Justice Shahid Kareem of LHC overturned PML-N leader Azhar Qayyum’s win announcement from NA 81 Gujranwala and restored PTI candidate Bilal Ejaz Chaudhry as MNA.

Justice Shahid gave this verdict on the petition of Bilal Ejaz Chaudhry of the Pakistan Tehreek-e-Insaf (PTI). Bilal Ejaz Chaudhry was declared successful with 8,000 votes.

The Election Commission of Pakistan (ECP) announced Azhar Qayyum as a successful winner after the vote’s recounting. During the recount, the returning officer decreased the petitioner’s vote total by 2500 votes.

However, the hearing bench questioned how could the election commission ignore the Supreme Court’s decision. Isn’t disregarding the Supreme Court’s verdict contempt of court? How could the election commission intervene after the completion of the election process?

PTI candidate Bilal Ijaz claimed in his petition that he won the February 2008 election by more than 7,000 votes. In recounting PML-N candidate Azhar Qayyum Nahra was declared the winner with a 3,100 votes margin.

Bilal Ijaz emphasized that ECP canceled the more than 10,000 votes of him after recounting. He urged the election commission not to order recounting after the tribunal constitution.

Hence, he asked the court to declare the recounting order of the ECP null and void. Following that, LHC suspends the victory notification of PMLN MPA Azhar Qayyum.

In a separate court hearing, LHC also banned PML-N candidate Rana Arshad’s win notice from PP-133, Nanka Sahib. The LHC instructed Pakistan’s Election Commission to respond in the case.

The development followed a petition filed by Muhammad Atif of the Sunni Ittehad Council (SIC), who had challenged Rana Arshad’s victory notification.

Muhammad Atif claimed that despite winning the election by 3500 votes, the ECP declared Rana Arshad was the successful candidate following a vote recount. He stated that the returning officer reduced the petitioner’s votes during the recount. It resulted in an official defeat by a margin of 2500 votes.

ECP declared Rana Muhammad Arshad the winner of PP-133 by a margin of 2,691 votes on April 6 following a recount. According to the returning officer, Rana Muhammad Arshad received 44,323 votes, while Mian Atif received 41,632.

However, the Lahore High Court (LHC) suspends the victory notification of two PMLN candidates considering it a violation of the tribunal constitution.
