IHC rejected remand of Sanam Javed to Balochistan Police
Islamabad High Court (IHC) rejected the remand of Sanam Javed to Balochistan Police in connection with the May 9 2023 vandalism case.
This decision came after Sanam’s father filed a petition in IHC while challenging custody of her daughter to Balochistan Police.
The petition requests that the IHC order to present Sanam Javed immediately in court and release her from alleged illegal detention. It also seeks details of all cases registered against her.
The petition also demanded to stop legal proceedings against her in these cases, claiming it was “political victimization.” Moreover, the petition asks the court to declare the process of her arrest or abduction illegal.
The legal team of Sanam argued that her arrest was illegal. Hence, they demand transparency and follow-up of legal procedures in the case against her. Following this, IHC rejected the transit remand of Sanam Javed to the Balochistan Police.
IHC Justice Gul Hasan Aurangzeb and Murad Shah issued this order and demanded federal authorities present her in court. He also instructed federal authorities not to allow Sanam Javed to leave Islamabad territory.
However, this legal battle started when Islamabad police re-arrested PTI activist Sanam Javed on July 14, 2024, and were likely to hand over her to Balochistan Police. This is because Balochistan police wanted her in connection with a 2023 case.
Following this, Islamabad police arrested Sanam to assist Balochistan Police upon their request. The Bijli Road Police Station in Quetta has filed a case from the May 2023 riots, including terrorism. They filed this case under 15 sections.
Hence, Sanam was scheduled to appear in Islamabad Session Court G-11 soon for transit remand and then be moved to Balochistan. It came after Balochistan Police requested assistance from federal authorities.
It is significant to note that the Islamabad Session Court judge had granted the transit remand of Sanam Javed to the Balochistan Police. However, the IHC overturned this ruling.
