IHC rejected govt appeal against fines on top officials in missing persons case
Islamabad High Court (IHC) rejected the appeal of the federal govt against fines on top officials including defense and interior secretaries in missing persons cases. Chief Commissioner and federal police officers are also among those IHC imposed fines.
This court’s decision came after an additional attorney general briefed IHC at the hearing. He informed the court the search for missing persons did not produce successful results.
IHC Chief Justice Aamer Farooq expressed dissatisfaction with the authority’s inability to find the missing people. He questioned what courts should do each time a law enforcement official shows up and claims that progress is being made. Moreover, he requests more time for every hearing.
Following this, the court considered that it should double the fine on the relevant officials. It emphasized Inspector General of Police (IG) and each federal secretary would pay this fine out of their paychecks.
IHC further noted that they had been hearing this case for the last seven years. It inquired about a law enforcement officer in court if they should call the prime minister to ensure they followed the rules.
Following this, the federal government filed an appeal against the imposition of fines in cases involving the disappearance of IT specialists. Sajid Mehmood, Omar Abdullah, and Mudassar Naro are missing IT persons.

However, the IHC panel led by Justice Aamer Farooq and Justice Miangul Hassan Aurangzeb rejected this govt appeal. This is because they observed several attorney generals and officers presented in court with no progress in recovering missing persons.
IHC remarked law enforcement officers have brought them to this level. It has become easy for the court to decide on this case by imposing the double fines on secretaries and IG which they will pay from their salaries.
IHC had earlier imposed a fine of PKR 100,000 on the former defense secretary Zamirul Hasan Shah, and Zulfiqar Shah. Zulfiqar is the former chief commissioner. Former IG (Khalid Khan Khattak), and deputy commissioner Mushtaq Ahmed will also pay a one lakh fine.
