BHC rejected plea to impose Article 6 on PTI founder Imran Khan
Balochistan High Court (BHC) rejected a plea to impose Article 6 on former prime minister and PTI founder Imran Khan. Article 6 refers to any person who conspires to abrogate, suspend, or overturn the constitution of Pakistan by use of force or by any other unconstitutional means shall be guilty of high treason.
A two-judge bench comprised of Justice Shaukat Rakhshani and Chief Justice Hashim Kakar of the BHC heard the Article 6 petition hearing against Imran Khan.
A lawyer named Amaullah Kunrani filed this petition against Imran Khan. The petitioner had appealed to prosecute Imran Khan for high treason under Article 6 for unconstitutionally dissolving the Punjab and KPK assembly.
Meanwhile, the lawyer of Imran Khan, Iqbal Shah Advocate, objected to the jurisdiction of the High Court. Hence, BHC rejected his plea to impose Article 6 on Imran Khan for lack of jurisdiction or power over it.
However, in a separate case, the District and Sessions Court of Islamabad has reserved its decision on the appeals of Imran Khan and Bushra Bibi against the sentence in the marriage case in Iddat. The court will likely announce the verdict in this case on May 29, 2024.

The defense lawyer Usman Gill wrapped up their arguments in front of court judge Shahrukh Arjumand. However, the complainant, Khawar Fareed Maneka, and his lawyer, Rizwan Abbasi, were not present in the court.
Meanwhile, Judge Shahrukh asked his associate to contact Rizwan Abbasi to complete his arguments in person or through a video link. However, Mr. Rizwan failed to appear, and hence court reserved its decision.
The sentence of the iddat case came out on February 4, 2024. Senior civil judge Quadratullah sentenced Imran and Bushra to seven years imprisonment for marrying during iddat (the waiting period). He also fined them PKR 5 million each and declared their marriage “un-Islamic.”
